Terms of Service

These terms govern use of Sitestack, a construction project management platform provided by [Sitestack legal entity name and company number to be confirmed] ("Sitestack", "we", "us"). By creating an account or using Sitestack, you agree to these terms.

Who can use Sitestack

Sitestack is a business tool. You must be at least 18 years old and either subscribing on behalf of a company (a "Customer") or have been invited into a project by one (a "User"). You're responsible for keeping your login credentials secure and for activity on your account.

Roles and access

Access within Sitestack is controlled by role — admin, manager, operative, or client — set by the Customer. A client's access is scoped to the specific project they were invited to. It's the Customer's responsibility to assign roles appropriately and to remove access when someone leaves a project or company.

Your content

You and your organization own the content you upload — photos, documents, tasks, and everything else you put into Sitestack. By uploading it, you grant us a limited license to host, process, and display it solely to provide the service to you. We don't use your content to train our own products, and we don't sell it.

Compliance features are an aid, not a substitute

Sitestack helps you gather, organize, and export evidence — geotagged photos, Part L thermal-performance records, progress and handover reports — to support Building Regulations compliance. These features are a record-keeping aid. They don't constitute Building Control sign-off, do not replace the judgement of a qualified professional (electrician, SAP assessor, Building Control officer, etc.), and Sitestack is not responsible for the accuracy or completeness of what your team chooses to record.

Variations and e-signatures

Sitestack lets a Customer send a client a request for additional work (a "Variation") with a cost, which the client can sign or decline electronically. A signed Variation records the signer's name, drawn signature, timestamp, IP address, and location where available, and cannot be edited or deleted once created. This is intended to function as a standard electronic signature recording assent to the terms described in the Variation. It isn't legal advice, and for high-value or disputed work, we'd recommend the parties also rely on their own written contract.

AI features

Sitestack's AI search and photo captions are generated automatically and can be inaccurate or incomplete. Don't rely on them for anything safety-critical or compliance-critical without checking the underlying source yourself.

Acceptable use

You agree not to:

  • Use Sitestack for anything unlawful, or upload content you don't have the right to share.
  • Attempt to break, bypass, or probe the security of the service.
  • Scrape, resell, or provide access to the service to anyone outside your organization without our consent.
  • Use the service to store or transmit malware, or to harass or harm others.

Fees and payment

Subscription fees are as set out in the plan or order you agreed to at sign-up. Fees are billed in advance and are non-refundable except where required by law. We may change our pricing with reasonable notice before it applies to your next billing period.

Term and termination

Either party may terminate a subscription as set out in the applicable plan. If your account is terminated, we'll provide a reasonable window to export your data before deletion, except where we're legally required to delete it sooner, or retain it longer (e.g. signed Variation records).

Service availability

We work to keep Sitestack available and reliable, but we don't guarantee the service will be uninterrupted or error-free. We'll give notice of planned maintenance where practical.

Disclaimers and limitation of liability

Sitestack is provided "as is". To the maximum extent permitted by law, we exclude all warranties not expressly stated in these terms, and our total liability to you for any claim arising from your use of Sitestack is limited to the fees you paid us in the 12 months before the claim arose. We're not liable for indirect or consequential losses, including lost profits or lost data, except where such exclusion isn't permitted by law.

Indemnity

You agree to indemnify us against claims arising from content you upload, your misuse of the service, or your breach of these terms.

Data protection

Our Privacy Policy describes how we handle personal data. Business Customers who need a formal Data Processing Agreement can request one from us.

Governing law

These terms are governed by the laws of England and Wales, and any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to these terms

We'll update the "Last updated" date above when we make changes, and let Customers know of any significant ones.
